TERMS AND CONDITIONS
This agreement is between Atlantic Consulting Partners Ltd trading as Max Headshots (referred to hereafter as “Max Headshots”) and the Client (referred to hereafter as “Client”).
Our terms and conditions are set out below.
1. Booking and Payment
a) Headshots
The Client is required to pay the session fee in full to confirm the booking. All session fees are non-refundable.
b) Corporate, Portraits and all other bookings which are not headshots
The client is required to pay a 50% deposit of the session fee to secure the booking. This deposit is non-refundable.
2. Rescheduling
Clients may reschedule a session without incurring any additional charges, provided the cancelation request is more than 48 hours before the originally scheduled appointment. A rebooking charge of half the session fee is charged if rescheduling is needed within 48 hours of the session.
Max Headshots reserves the right to reschedule due to illness, weather, equipment malfunction, strikes or other circumstances beyond its control. Max Headshots and Client shall endeavour to reschedule the session. If a reschedule cannot be agreed upon, Max Headshots shall forthwith refund any fees paid by the client and shall have no further liability.
3. Selection and delivery of images
The client will select the images they wish to receive as edited versions at the end of the session. The selected images will be edited and delivered to the Client within the following timeframes:
a) Headshots: within 48 hours of the shoot
b) Portrait: within three working days of payment for all images being received in full
c) Corporate: within five working days of payment for all images being received in full
4. Express Service for Portrait and Corporate shoots
Subject to availability, Max Headshots may offer an Express Service to deliver images within 24 hours of payment in full for Portrait and Corporate shoots. The Express Service fee is equal to 50% of the session fee. Please ask if you require this service.
5. Copyright and Licensing
Clients are granted a license to use the images for any lawful purpose, which includes but is not limited to social media profiles, professional networking and corporate web sites. Should the images be used in publications we would greatly appreciate a photo credit: “Photo by Max Headshots”.
Max Headshots retains copyright ownership of all images and any other content such as video created under this agreement (“The Materials”). As the copyright owner, Max Headshots has usage rights which include but are not limited to the right to use, manipulate, reproduce, distribute, and display The Materials for any lawful purpose, including but not limited to advertising, promotion, and sale of products and services, print media, websites and social media platforms.
6. Archive
After one (1) month from the date of the session, the Materials will be deleted from Max Headshots’ hard-drives and cloud storage, except as needed for promotional purposes, to be determined at Max Headshots’ sole discretion.
7. Limitation of Liability
In the event that the Materials are lost through camera or media malfunction or otherwise lost or damaged or if Max Headshots fails to perform for any reason, Max Headshots shall not be liable for any amount in excess of the value of the Client’s order.
8. Governing law and venue
This Agreement shall be governed by and construed in accordance with the laws of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Agreement or its subject matter or formation.
9. Acceptance of this Agreement
By booking a session with Max Headshots, the Client agrees to abide by these terms and conditions.
